1 – Why didn’t Islam completely ban slavery, as the US president, Abraham Llincoln did?
2 – How does Islam permit a sexual relationship between a man and a woman only
because she is a maid?

How did the US president, Abraham Llincoln liberate slaves?

The presidential declaration and executive decree issued by the US president,
Abraham Llincoln on January the 1st.1863 during a dire civil war.
As slavery was tackled with a legally binding way which led to the liberation of slaves
in the USA.
However, the psychological state  of both the white people and the black people was full of lack of persuasion.
Till now, the relation between both parties is not that of equality or mutual acceptance in reality.
After 120 years, the black people still can’t sit in the area allocated for
the white people on the public transport or attend the schools of the white people.
Racism has become a non -stop and ever-growing plantation till now.

How has Islam tackled the issue?

( learn Islam ) Islam has a totally different  and comprehensive prespective.
So Islam started to dry up the sources of slavery:

( learn Islam) Almighty said

فَإِذَا لَقِيتُمُ الَّذِينَ كَفَرُوا فَضَرْبَ الرِّقَابِ حَتَّى إِذَا أَثْخَنْتُمُوهُمْ فَشُدُّوا الْوَثَاقَ فَإِمَّا مَنًّا بَعْدُ وَإِمَّا فِدَاءً حَتَّى تَضَعَ الْحَرْبُ أَوْزَارَهَا ذَلِكَ وَلَوْ يَشَاءُ اللَّهُ لَانْتَصَرَ مِنْهُمْ وَلَكِنْ لِيَبْلُوَ بَعْضَكُمْ بِبَعْضٍ وَالَّذِينَ قُتِلُوا فِي سَبِيلِ اللَّهِ فَلَنْ يُضِلَّ أَعْمَالَهُمْ محمد 4…
So, when you meet (in fight Jihâd in Allâh’s Cause), those who disbelieve smite at their necks till
when you have killed and wounded many of them, then bind a bond firmly
(on them, i.e. take them as captives).
Thereafter (is the time) either for generosity (i.e. free them without ransom),
or ransom (according to what benefits Islâm), until the war lays down its burden.
Thus [you are ordered by Allâh to continue in carrying
out Jihâd against the disbelievers till they embrace Islâm (i.e. are saved from the punishment in the Hell-fire)
or at least come under your protection],
but if it had been Allâh’s Will, He Himself could certainly … surah muhammad 4

So Islam has made genorosity on the one hand and ransom on the other,
a solution for the war captives; as in the verse above.
Also Islam has prohibited giving children and individual as human gifts.
Also Islam has prohibited selling children.
Islam has banned taking a person as a slave for the person’s unpaid debts.
Likewise, Islam has stopped slavery as a punishment.
Islam has ligislated a contract between a master and his slave,
( i. e. A contract with a fixed price for the slave including a second article according to which the master gives away 25% of the price at least.)
Among such examples which dry up the sources of slavery,
Islam has begun to deal with the ipso facto and the actual slaves who had existed before Islam,
and found out for them many outlets which implied being closer to Allah.

( learn Islam) Almighty said

(وَمَا كَانَ لِمُؤْمِنٍ أَنْ يَقْتُلَ مُؤْمِنًا إِلَّا خَطَأً وَمَنْ قَتَلَ مُؤْمِنًا خَطَأً فَتَحْرِيرُ رَقَبَةٍ مُؤْمِنَةٍ وَدِيَةٌ مُسَلَّمَةٌ إِلَى أَهْلِهِ إِلَّا أَنْ يَصَّدَّقُوا فَإِنْ كَانَ مِنْ قَوْمٍ عَدُوٍّ لَكُمْ وَهُوَ مُؤْمِنٌ فَتَحْرِيرُ رَقَبَةٍ مُؤْمِنَةٍ وَإِنْ كَانَ مِنْ قَوْمٍ بَيْنَكُمْ وَبَيْنَهُمْ مِيثَاقٌ فَدِيَةٌ مُسَلَّمَةٌ إِلَى أَهْلِهِ وَتَحْرِيرُ رَقَبَةٍ مُؤْمِنَةٍ فَمَنْ لَمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ تَوْبَةً مِنَ اللَّهِ وَكَانَ اللَّهُ عَلِيمًا حَكِيمًا)  النساء 92
It is not for a believer to kill a believer except (that it be) by mistake, and whosoever kills a believer by mistake,
(it is ordained that) he must set free a believing slave and a compensation
(blood money, i.e Diya) be given to the deceased’s family, unless they remit it.
If the deceased belonged to a people at war with you and he was a believer; the freeing of a believing slave (is prescribed),
and if he belonged to a people with whom you have a treaty of mutual alliance, compensation (blood money – Diya) must be paid to his family, and a believing slave must be freed. And whoso finds this (the penance of freeing a slave) beyond … surah Alnsaa 92

Almighty said

(لا يُؤَاخِذُكُمُ اللَّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَكِنْ يُؤَاخِذُكُمْ بِمَا عَقَّدْتُمُ الْأَيْمَانَ فَكَفَّارَتُهُ إِطْعَامُ عَشَرَةِ مَسَاكِينَ مِنْ أَوْسَطِ مَا تُطْعِمُونَ أَهْلِيكُمْ أَوْ كِسْوَتُهُمْ أَوْ تَحْرِيرُ رَقَبَةٍ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ ذَلِكَ كَفَّارَةُ أَيْمَانِكُمْ إِذَا حَلَفْتُمْ وَاحْفَظُوا أَيْمَانَكُمْ كَذَلِكَ يُبَيِّنُ اللَّهُ لَكُمْ آيَاتِهِ لَعَلَّكُمْ تَشْكُرُونَ المائدة89
Allâh will not punish you for what is uninentional in your oaths,
but He will punish you for your deliberate oaths; for its expiation (a deliberate oath)
feed ten Masâkin (poor persons), on a scale of the average of that with which you feed your own families;
or clothe them; or manumit a slave. But whosoever cannot afford (that), then he should fast for three days.
That is the expiration for the oaths when you have sworn . And protect your oaths (i.e. do not swear much) .
Thus Allâh makes clear to you His Ayât (proofs, evidence, verses, lessons, signs, revelations, etc.)
that you may be grateful… surah Al Maidah 89

( learn Islam) Almighty said

( وَالَّذِينَ يُظَاهِرُونَ مِنْ نِسَائِهِمْ ثُمَّ يَعُودُونَ لِمَا قَالُوا فَتَحْرِيرُ رَقَبَةٍ مِنْ قَبْلِ أَنْ يَتَمَاسَّا ذَلِكُمْ تُوعَظُونَ بِهِ وَاللَّهُ بِمَا تَعْمَلُونَ خَبِيرٌ ) المجادلة 3
And those who make unlawful to them (their wives) (by Az-Zihâr ÇáÙåÇÑ)
and wish to free themselves from what they uttered, (the penalty) in that case (is) the freeing
of a slave before they touch each other.
That is an admonition to you (so that you may not return to such an ill thing).
And Allâh is All-Aware of what you do… surah Al mojadala 3 Slavery and the owned women … learn Islam Almighty said

( فَكُّ رَقَبَةٍ ) البلد 13
(It is) Freeing a neck (slave, etc.) … surah Al Balad 13

 As to the intimate relationship between a maid and her  master like a husband,
Islam has dealt with a status quo which had existed before Islam.
A maid used to be a part of her master’s possessions 
with whom he could do whatever he liked.
Islam gave her the right to be asked for her consent to be bed partner, if she liked.
If she refused, the master had the right to sell her.
Islam has organised this and made it lawful.
A maid is to be free as soon as she gives birth to a baby by her master.
She is not to be bought or sold. The born baby is to be a free person due to the freedom of one of the baby’s parents.

This was a way to attain freedom.

Honest talk

 “ Any master who owns a maid, and brings her up well and frees her to marry her,
he will be rewarded
two- folds.Every slave carries out the duties of Allah as well as his master, the slave will be rewarded two-folds.

“ I engaged in an argument during which we cursed each other, and his mother was a non-Arab.
I belittled him because of his mother.
The man complained to the prophet who said:
“Oh Abu Thar, you have ignorance within yourself.
They- slaves- are your brothers and sisters.
Allah has favored you more than them.
If you don’t like any of them, sell them, otherwise do not torture the creatures of Allah.”

” One day, I met Abu Thar at al-Rabdha, wearing a nice dress; and his slave was wearing likewise.
I asked him about that.
He said:”      
“ I engaged in an argument in which we cursed each other, and his mother was a non-Arab.
I belittled him because of his mother. The man complained to the prophet who said:
“Oh Abu Thar, you have [Jahiliah] ignorance within yourself.
They- slaves- are your brothers and sisters.
Allah has favored you more than them. If you don’t like any of them, sell them, otherwise do not torture the creatures of Allah.
Whoever is privileged with having their fellow human beings, let them eat from your own food; and wear a part of your clothes.
Don’t weary them out. If you assigned them some weary tasks, help them through.”
